Terms of Use

1. Agreement

By creating an account, downloading the App, or continuing to use the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

What The Food is a food journal and nutrition assistant. It helps you log meals (including from text or photos), estimate nutrition, keep a library of foods, chat with an in-app assistant, and optionally sync with Apple Health.

Features may change as we improve the App. Some features require a paid subscription or an active internet connection.

4. Eligibility

You must be at least 13 years old (or the higher minimum age required in your country) to use the App. If you are under the age of digital consent in your jurisdiction, you may use the App only with parent or guardian involvement as required by law.

5. Account

• You are responsible for activity under your account and for keeping your device and Apple ID secure.
• Provide accurate information where the App asks for it (for example profile details that affect calorie estimates).
• You may delete your account by contacting support@whatthefood.co.uk or through in-app account deletion when available. Deletion is handled as described in the Privacy Policy.

6. Acceptable use

You agree to use the App only for lawful personal nutrition tracking and related educational use. You must not:

• break the law or infringe others’ rights;
• attempt to disrupt, reverse engineer (except where mandatory law allows), or abuse the App, API or other users;
• upload content you have no right to send, or content that is illegal, harmful or deceptive;
• misuse the assistant for clinical diagnosis, emergency care, or topics outside nutrition / everyday wellness education;
• resell or commercially exploit the App without our written permission.

We may suspend or terminate access if we reasonably believe you violated these Terms.

We do not sell your nutrition or health data. See the Privacy Policy for how data is handled.

8. Subscriptions and payments (Apple In-App Purchase)

Paid plans are sold as auto-renewable subscriptions through Apple’s In-App Purchase. Price, duration, and any free trial are shown in the App before you confirm purchase, and in the App Store product page.

• Payment is charged to your Apple ID account at confirmation of purchase.
• Renewal — the subscription renews automatically unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
• Manage / cancel — Settings → [your name] → Subscriptions on your Apple device, or as Apple otherwise provides.
• Restore — use Restore Purchases on the paywall or subscription screen in the App after reinstall or on a new device signed into the same Apple ID.
• Refunds — requested and decided by Apple under Apple’s refund policies; we do not process card refunds directly.

Unused portions of a free trial, where offered, are forfeited when you purchase a subscription, as applicable under Apple’s rules.

9. Intellectual property

The App, branding, and our original content are owned by AV PRO GROUP LTD or our licensors. You receive a limited, non-exclusive, non-transferable licence to use the App for personal use in line with these Terms. Food reference data may be provided by third parties (for example FatSecret) under their licences.

You retain rights in content you create (messages, photos, custom foods). You grant us a licence to host, process and display that content solely to operate and improve the App.

10. Third parties

The App relies on third-party services (including Apple, Google Firebase / Cloud, Adapty, OneSignal, PostHog and FatSecret). Their terms and privacy notices also apply to their services. We are not responsible for third-party sites or services we do not control.

11. Suspension and termination

You may stop using the App at any time and cancel subscriptions via Apple. We may suspend or end access if you breach these Terms, if required by law or Apple, or if we discontinue the App (with reasonable notice where practicable). Provisions that by nature should survive (including disclaimers, liability limits, and governing law) survive termination.

12. Liability

The App is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for decisions you make based on nutrition estimates or assistant output. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law (including for death or personal injury caused by negligence, or fraud).

Our aggregate liability arising out of or relating to the App is limited to the greater of (a) the amounts you paid us for the App subscriptions in the 12 months before the claim or (b) fifty pounds sterling (£50), except where law requires otherwise.

13. Governing law

These Terms are governed by the laws of England and Wales. Courts of England and Wales have exclusive jurisdiction, except that if you are a consumer you may also bring proceedings in your place of residence where mandatory consumer law so provides.

14. Changes

We may update these Terms. The new version will be posted on this page with an updated effective date. If you continue using the App after the effective date, you accept the updated Terms. If you do not agree, stop using the App and cancel any subscription via Apple.
